These General Contracting Conditions (hereinafter, General Conditions) regulate the process of sale of the products offered by LA RUECA VOLADORA, S.L. in the catalog available on its website www.laruecavoladora.com
The General Conditions bind to RUECA VOLADORA, S.L., and to the buyer (Client), granting them a series of rights and obligations, from the moment in which the latter makes and accepts an order through this page. They are mandatory and knowledgeable by both parties, so their acceptance is essential to be able to formalize an order. Therefore, the Customer must read these conditions carefully.

6. DELIVERY TERMS OF THE ORDERS
On weekends and holidays there are no shipments or deliveries.
The delivery times for the orders depend on the availability of the product or products that compose them. In case the product is in stock, orders will be delivered within the period indicated from the formalization of the order. It may happen that the selected product is not in stock at that moment, then we will contact you and inform you of the expected delivery date.
However, the delay in delivery does not imply any compensation and will only entitle the Customer to cancel the order when the circumstances described in the section ‘CANCELLATION OF ORDERS’ of these conditions are met. Any penalty clause for delay introduced by the Customer in his order is without effect. The exercise of any claim for lost profits is expressly excluded by both parties.
The orders will be delivered by the transport company at the delivery address indicated by the Client and to the person who has set himself as receiver of the same. These data will be entered in the delivery note of the transport company, which will also indicate the number of packages of the shipment, the total weight, the order number.
In addition to the delivery note, the Customer will be delivered with each order, either within the shipping package, or together with the product sent, a purchase invoice. In some cases, it will be sent via email or by ordinary mail.
If the invoice is missing, the Customer may request it by email to info@laruecavoladora.com indicating the name of the invoice holder and the order number, and it will be sent to the invoice address by ordinary mail or email.
7. PRODUCT GUARANTEE
The legal guarantee framework (RD 1/2007 approving the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws) is intended to provide the Client with different options to demand remediation when the good acquired is not in accordance with the contract, giving the option to demand repair or replacement of the property, unless it is impossible or disproportionate. When the repair or replacement is not possible or is unsuccessful, the consumer may demand the price reduction or termination of the contract. A term of two years is recognized, from the moment of purchase so that the Customer can make these rights effective (provided that the product has manufacturing defects and not by the mere wear and tear of it) and a period of three years, also counted from the moment of purchase, so that you can exercise, where appropriate, the appropriate legal actions. In any case, the guarantee of the brand or manufacturer will apply.
By virtue of this, LA RUECA VOLADORA, S.L. will respond to the Client of any lack of conformity that exists at the time of delivery of the products of the order, understanding these
as tangible assets destined for private consumption.
To be able to face this guarantee, the Customer must contact LA RUECA VOLADORA, SL, by email to the address info@laruecavoladora.com in which it will indicate: name of the order holder, order number, number of invoice and cause of nonconformity.
Warranty cases will not be accepted when the products have been used improperly or not according to their characteristics by the Client. For all aspects of the commercial guarantee referred to in article 123 of Royal Decree 1/2007, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, the following shall apply: contained in Law 7/1996, of January 15, on the Regulation of Retail Trade.
8. DEVOLUCIONES
Se reconoce al Cliente el derecho a desistir del pedido, (devolver el pedido) en el plazo de 14 días naturales contados desde la recepción del mismo, tal y como recoge el artículo 71 del Real Decreto
Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.
Para ello, deberá ponerse en contacto vía email con la dirección info@laruecavoladora.com (dentro de ese plazo de 14 días) comentando los motivos de la devolución e indicando una dirección donde, la empresa de transportes, pueda ir a recoger la mercancía.
Fuera de dicho plazo, no se aceptarán revocaciones de pedidos, ni tampoco sobre pedidos de suministro de bienes confeccionados conforme a las especificaciones del Cliente o claramente personalizados, o que, por su naturaleza, no puedan ser devueltos o puedan deteriorarse o caducar con rapidez, etc. que hubiesen sido desprecintados y/o usados por el Cliente.
Cuando el Cliente haya ejercido el derecho de desistimiento o el de resolución, LA RUECA VOLADORA, S.L. estará obligado a devolver las sumas abonadas por el Cliente. La devolución de estas sumas se efectuará lo antes posible y, en cualquier caso, en un plazo máximo de 14 días haya sido informado de la decisión de desistimiento del contrato por el consumidor y usuario.
El coste de los envíos de las devoluciones una parte correrá a cargo de El Cliente y otra correrá a cargo de LA RUECA VOLADORA, S.L. Tenga en cuenta que si Usted decide devolvernos los artículos a portes debidos estaremos autorizados a cargarle los gastos en que podamos incurrir.
Para proceder al cambio o devolución los productos deben estar en las mismas condiciones en las que los recibió, con el envoltorio original y no pueden haber sido usados.
9. CANCELLATION OF ORDERS

10. NOTIFICATIONS
For the purposes of notifications, requirements and writings of any kind to which this contract gives rise, it shall be understood as the address of LA RUECA VOLADORA, S.L. the one indicated in the present General Conditions.
11. VALIDITY OF THE CLAUSES
Even if the invalidity or inapplicability of a clause of this contract or one of its parts is declared, the rest of the clauses or their parts will continue to be valid and have value.

These General Conditions are governed by current Spanish regulations, and specifically by: Civil Code, Royal Decree 1/2007 by which the Consolidated Text of the General Law for the defense of Consumers and Users and other complementary laws is approved, Law 7/98 of April 13 of General Conditions of the Contracting, Law 7/96 of January 15 of Ordination of the Retail Trade, Directive 2000/31 CE of the European Parliament and of the Council of June 8, Law 34/2002 of July 11 Services of the Information Society and Electronic Commerce, and the regulations that develop them.
